Terms of Service

1. Agreement to Terms

Welcome to Painting Services. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

2. Services Provided

Painting Services provides professional painting and related services, including but not limited to:

  • Interior and exterior residential painting
  • Commercial painting services
  • Cabinet refinishing and restoration
  • Color consultation and design advice
  • Surface preparation and finishing
  • Specialty coating applications

3. Quotes and Estimates

3.1 Requesting Quotes

All quotes and estimates provided are based on the information you supply and our visual inspection of the project site. Quotes are valid for 30 days from the date of issue unless otherwise specified.

3.2 Quote Accuracy

We strive to provide accurate estimates, but final costs may vary based on unforeseen circumstances discovered during the project, such as hidden damage, additional prep work required, or changes to the scope of work requested by the client.

3.3 Changes to Scope

Any changes to the agreed-upon scope of work must be approved in writing and may result in additional charges. We will provide a revised estimate for your approval before proceeding with additional work.

4. Payment Terms

4.1 Payment Schedule

Payment terms will be specified in your service agreement. Typically, we require:

  • A deposit of 30-50% upon signing the contract
  • Progress payments for larger projects as specified in the agreement
  • Final payment upon satisfactory completion of the work

4.2 Accepted Payment Methods

We accept cash, checks, bank transfers, and major credit cards. A convenience fee may apply to credit card transactions.

4.3 Late Payments

Payment is due as specified in your service agreement. Late payments may be subject to interest charges of 1.5% per month (18% per annum) or the maximum rate permitted by law, whichever is less.

5. Scheduling and Cancellations

5.1 Project Scheduling

We will make every effort to complete your project within the estimated timeframe. However, delays may occur due to weather conditions, material availability, or unforeseen circumstances. We will communicate any significant delays promptly.

5.2 Client Cancellations

If you need to cancel or reschedule:

  • Cancellations made more than 7 days before the scheduled start date: Full refund of deposit minus 10% administrative fee
  • Cancellations made 3-7 days before start date: 50% of deposit refunded
  • Cancellations made less than 3 days before start date: No refund of deposit

5.3 Our Right to Cancel

We reserve the right to cancel or reschedule services due to weather conditions, safety concerns, or other circumstances beyond our control. In such cases, we will provide a full refund or reschedule at your convenience.

6. Client Responsibilities

To ensure the successful completion of your project, you agree to:

  • Provide accurate information about the project scope and any existing conditions
  • Ensure access to the work area during scheduled work hours
  • Remove or protect personal belongings and valuables in the work area
  • Provide utilities (water, electricity) necessary for the work
  • Inform us of any hazardous materials or special conditions on the property
  • Ensure pets are secured and will not interfere with work
  • Notify us immediately of any concerns or issues during the project

7. Warranty and Guarantees

7.1 Workmanship Warranty

We guarantee our workmanship for a period of 2 years from the date of completion. This warranty covers defects in application, peeling, blistering, or other failures that result from improper workmanship.

7.2 Warranty Exclusions

Our warranty does not cover:

  • Damage caused by acts of nature, accidents, or abuse
  • Normal wear and tear
  • Structural defects or substrate failure
  • Damage from improper maintenance or cleaning
  • Modifications or repairs made by others
  • Product failures due to manufacturer defects (covered by manufacturer warranty)

7.3 Material Warranties

Paint and materials are covered by the manufacturer's warranty. We will assist you in making warranty claims for defective materials when applicable.

8. Limitation of Liability

8.1 Insurance Coverage

We maintain general liability insurance and workers' compensation coverage. Proof of insurance is available upon request.

8.2 Liability Limits

To the maximum extent permitted by law, our total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific services in question.

8.3 Property Damage

While we take every precaution to protect your property, we are not liable for damage to items not properly disclosed or protected, pre-existing conditions, or damage resulting from hidden defects that become apparent during the work.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Painting Services or its content suppliers and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission. We may use photographs of completed projects for marketing purposes unless you request otherwise in writing.

10. Dispute Resolution

10.1 Good Faith Efforts

In the event of any dispute, both parties agree to first attempt to resolve the matter through good faith negotiation and communication.

10.2 Mediation

If direct negotiation fails, the parties agree to attempt mediation before pursuing legal action. The costs of mediation shall be shared equally.

10.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

11. Safety and Compliance

We are committed to maintaining a safe work environment and comply with all applicable safety regulations and building codes. Our employees are trained in proper safety procedures and use appropriate personal protective equipment.

We use low-VOC and environmentally responsible products when possible and dispose of all waste materials in accordance with local regulations.

12. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with any service agreement and our Privacy Policy, constitute the entire agreement between you and Painting Services regarding the use of our services and supersede all prior agreements and understandings.
